FISP SWARMP Civil Penalty Reminder
As of February 21, 2020, the Department of Buildings can leverage a civil penalty for failure to correct a Safe with Repair and Maintenance Program (SWARMP) on Façade Inspection Safety Program (FISP) eligible buildings deemed unsafe because the owner failed to correct conditions identified in the previous FISP report.
Failure to correct the condition can result in a violation and a one-time civil penalty of $2,000.
To Pay a Penalty
Penalties can be paid to the Central Cashier located on the first floor of 280 Broadway, Manhattan.
Acceptable payment options include:
· Certified check
· Bank or cashier’s check
· US postal money order
· Credit card (requires a non-refundable 2% convenience fee)
Challenging a SWARMP Civil Penalty
A building owner can challenge a SWARMP violation and penalty if proof is provided (see 1 RCNY §103-04) that the violation was issued in error.
To submit a challenge, the owner must complete a Façades Waiver of Civil Penalties Form and email it to facades@buildings.nyc.gov.
